Tiltrio — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tiltrio web game (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Tiltrio is a single-page browser game — 3D tic-tac-toe with a gravity-tilt mechanic. The Service is provided free of charge during the current alpha period. There are no user accounts, no payments, no in-game purchases, and no user-generated content.
2. Eligibility
You may use the Service if you can form a binding contract under the laws of your jurisdiction. The Service is not directed at children under 13 and we do not knowingly collect any information that would identify a child user. If you are under 13, please do not use the Service.
3. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code beyond what is publicly available in the project's open repository.
- Use the Service to harass, defame, or harm any person.
- Probe, scan, or otherwise attempt to identify vulnerabilities in the Service in a manner that disrupts other users — please report security issues responsibly to the contact address in Section 10.
- Use automated systems (bots, scrapers, headless browsers) to overload the Service.
4. Intellectual property
The Tiltrio name, gameplay, design, and accompanying visual assets created by the operator are the intellectual property of the operator. The Service includes third-party assets used under their respective licenses:
- Sound effects: Kenney interface and audio packs (CC0 / public domain).
- Background music: Licensed from Pixabay under the Pixabay Content License — free for commercial use, no attribution required.
- Background images: AI-generated via OpenAI tools under the operator's paid OpenAI subscription, which grants commercial use rights.
- Open-source libraries: Three.js, React, Vite, and others — used under their respective MIT / BSD permissive licenses.
5. Health & safety
Tiltrio uses 3D animations and audio. Animations are gentle (no strobing, no rapid color flashes) and respect your operating system's reduced-motion preference, but the following standard precautions apply:
- Photosensitivity: A small percentage of people may experience seizures or other symptoms triggered by visual patterns or flashing lights, even from sources without obvious flashing. If you or anyone in your family has a history of epilepsy or seizures, consult a doctor before playing. Stop playing immediately and consult a doctor if you experience dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, or convulsions.
- Motion sensitivity: The camera can be rotated freely. If you are prone to motion sickness, limit camera rotation or take breaks.
- Repetitive strain: Take regular breaks during extended play and stop if you experience eye, hand, or wrist discomfort.
You assume the risk of using the Service. The operator is not liable for any health condition or injury related to your use of the Service, subject to Section 7 (Limitation of liability).
6. AS-IS — no warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. THE OPERATOR DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL ARISING FROM YOUR USE OF — OR INABILITY TO USE — THE SERVICE. THE OPERATOR'S TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (a) USD $50 OR (b) THE TOTAL AMOUNT YOU HAVE PAID THE OPERATOR FOR USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
8. Changes to the Service or Terms
The operator may modify, suspend, or discontinue the Service at any time without notice. The operator may also update these Terms; material changes will be reflected in the "Last updated" date at the top of this document. Continued use of the Service after a change constitutes acceptance of the updated Terms.
9. Termination
The operator may suspend or terminate your access to the Service at any time for any reason, including but not limited to violation of these Terms. You may stop using the Service at any time.

11. Governing law
These Terms are governed by the laws of the State of California, United States of America, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in California.
12. Severability
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect.
